Terms of service

These Terms form an agreement between you and Emile Eksteen Lubbe, trading as TradePocket, the operator and supplier of TradePocket. By creating an account, purchasing a subscription or using the service, you agree to these Terms, the Privacy policy, the Refund policy and the plan details shown before purchase.

You must be legally able to enter a contract. If you use TradePocket for a business or organization, you confirm that you have authority to bind it.

You must provide accurate information, protect your login credentials and promptly report suspected unauthorized access. You are responsible for activity under your account and for the accuracy and lawful use of customer, employee, job, payment-status, review, communication and website information you submit.

You must maintain the notices, permissions and lawful basis required to contact customers, process employee information, send campaigns, request or publish reviews, store job information and upload personal data or content.

TradePocket grants you a limited, non-exclusive, non-transferable right to use the service for your own business during the applicable subscription term.

You must not use TradePocket to violate law or third-party rights, send spam, manipulate reviews, publish deceptive claims, distribute malware, bypass product limits or security, scrape or probe the service without permission, interfere with other users, or reverse engineer protected parts of the service except where law expressly permits it.

We may limit or suspend access where reasonably necessary to address abuse, security risk, non-payment, legal requirements or harm to TradePocket, customers or third parties.

You retain ownership of business information, customer data, logos, original images and other content you provide. You grant TradePocket a worldwide, non-exclusive license to host, reproduce, adapt and transmit that material only as needed to provide, secure and improve the service.

When you request a suggestion from the AI Business Assistant, relevant information may be processed to prepare that suggestion. Assistant output can contain errors. You remain responsible for checking facts, recipients, prices, legal claims and final content before approving or sending it. TradePocket does not silently send customer communications or publish material prepared by the AI Business Assistant without the approval described in the product.

When a checkout identifies FastSpring as the seller or authorized reseller, FastSpring is the Merchant of Record and legal seller for that purchase. FastSpring handles payment processing, applicable indirect tax, buyer invoices and receipts, fraud review, eligible refunds and payment disputes. The purchase is also subject to the FastSpring Terms of Sale. TradePocket remains the product supplier and provides product support.

Only products presented and accepted through a FastSpring checkout are sold by FastSpring. Any separately signed custom scope or order must match the seller and payment route identified in that order or checkout.

Prices, currency, billing interval and included scope are shown before purchase. Paid subscriptions renew automatically until cancelled. To prevent the next renewal, cancel through the available TradePocket or FastSpring account controls before the renewal is processed. Access normally continues until the end of the paid period. No free plan is included.

The Employee Add-on is a manual recordkeeping and document-preparation tool, not a payroll bureau, payment service, tax calculator or legal-compliance service. You are responsible for verifying employee classification, hours, leave, rates, deductions, totals, notices, retention and every payslip before use, and for obtaining qualified advice where needed. TradePocket does not move employee funds or submit payroll or government filings.

Where your order includes managed growth, you authorize TradePocket to prepare the stated content, syndication, review-support and reporting deliverables and, where applicable, to access the connected business profiles or analytics properties you approve. You remain responsible for approving business claims and granting the permissions needed for connected services. Search position, traffic, enquiries and revenue are not guaranteed.

TradePocket Office is an optional add-on to Core, Complete or Ultimate. The country of the provisioned business number determines the available package and monthly price. The United States and Canada package includes 500 regular domestic call minutes and 60 separate receptionist minutes. The United Kingdom and Australia package includes the same separate allowances. Receptionist cover is optional to use. Additional eligible usage requires a successfully paid prepaid top-up or another usage arrangement shown and accepted in the product.

Number availability, type, features, transfer eligibility, messaging, caller identification and routing depend on country, provider coverage, business verification and applicable rules. You must provide accurate verification information and cooperate with number or transfer requirements. A requested number is not guaranteed until provisioning is complete. Transfer timing may depend on the existing carrier and the accuracy of the account information supplied.

Office is not an emergency calling service and must not be relied on as the only way to contact emergency services. You are responsible for maintaining a suitable direct calling method and for using Office lawfully. You must not use it for spam, unlawful calling or messaging, impersonation, harassment, fraud, evasion of calling rules or activity that risks numbers, networks or other customers.

You control whether permitted recording or transcription features are enabled. You are responsible for a lawful purpose, required notices and consent, appropriate retention and an alternative where the law requires one. Availability may be restricted or disabled by country, call type or provider capability. The TradePocket AI Business Assistant may provide receptionist cover only within the services, boundaries and approval controls shown in the product. It is not a substitute for emergency response, professional advice or your review of material customer commitments.

Allowances reset according to the billing cycle shown in your order and do not roll over unless expressly stated. Unused allowance and top-up balances are not redeemable for cash. We may suspend or restrict Office where payment, verification, provider, safety, abuse or legal requirements make that necessary. Cancellation and number-transfer options are subject to account status, provider requirements, outstanding charges and applicable portability rules.

Where your order includes TradePocket Sites, the stated setup scope covers structured intake, an approved website direction from the available examples, the agreed launch pages, supplied-asset preparation, defined connections, one consolidated revision round and launch checks. The setup also includes registration of one suitable available domain within a reasonable registration cost, or DNS configuration or transfer work for one existing domain, subject to registrar access and transfer eligibility. New pages, a different design direction, custom functionality, ecommerce and integrations outside that scope require a separate quote or purchase.

You confirm that business facts are accurate and that you have the right to use supplied logos, photos, testimonials, licenses, claims and other material. Launch depends on timely content, approvals and domain access. TradePocket will not publish the website automatically when intake is submitted.

The monthly Sites service covers managed hosting, SSL, security and platform updates, maintenance, performance monitoring and the support allowance shown in the purchased plan. Your domain, business information, leads, reviews, logo and original images remain yours. During managed operation, TradePocket retains its underlying design system and reusable components.

If you cancel the managed website without buying ownership, you retain your domain, approved content, logo and original images. TradePocket provides the agreed data or content export. The managed deployment remains available for any grace period stated in your order or cancellation notice and is then unpublished.

A separate website ownership purchase transfers the agreed customer repository or source, approved content, processed assets and deployment documentation described in the order. Monthly subscription payments pay for hosting, management, support, updates and connected services. They are not installment payments toward ownership.

A website buyout does not provide perpetual access to TradePocket APIs. Live reviews, lead management, booking connections and promotions continue only while the relevant TradePocket services remain active, unless the handover replaces them with an agreed static or third-party alternative.

Refund eligibility and processing are described in the Refund policy. Fees are not refundable except as stated there, agreed in writing or required by mandatory law.

We may maintain, secure and improve the service and may change features. If a change materially reduces paid core functionality, we will provide reasonable notice where practical. Preview or beta features may change or be withdrawn.

TradePocket, its software, interface, trademarks, design system and original materials belong to Emile Eksteen Lubbe, trading as TradePocket or its licensors except for content expressly transferred under a completed Sites ownership purchase.

TradePocket is provided with reasonable care but is not guaranteed to be uninterrupted, error-free or compatible with every third-party service. To the maximum extent permitted by law, implied warranties are excluded.

Neither party is liable for indirect, incidental, special or consequential loss. Our total liability arising from the service is limited to the fees paid for TradePocket during the 12 months before the event giving rise to the claim. These exclusions do not apply to fraud, willful misconduct or liability that law does not allow to be excluded or limited.

You may stop using TradePocket at any time. We may terminate an account for material breach, unlawful use, serious security risk or prolonged non-payment, with reasonable notice where circumstances permit. Provisions that by their nature should survive termination remain effective.

These Terms are governed by the laws of South Africa, excluding conflict-of-law rules. Courts with jurisdiction over the operator’s place of establishment have non-exclusive jurisdiction, subject to mandatory consumer rights. Notices may be sent to hello@tradepocket.pro.
